Definitions and Interpretations

For the purposes of this Privacy Policy:

Services refers to the People, Culture and Change (People due diligence, Culture Identity, Head hunting, Offboarding), Employee Assistance Programs, Insights services offered by KHC.

Service Provider means any natural or legal person who may be employed by the Company to process data on behalf of or to facilitate provision of the Services by the Company.

Third-Party Social Media Service refers to any website or any social network site through which a User can log in or create an account and use or access parts of the Service.

Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself

A. Personal Data

• KRA Pin
• IHRM Account Number
• Passport photo
• ID Copies/Passport photo/Birth certificate/Marriage certificate
• Business Registration details
• Bank account/Mobile money details

B. Usage Data

Usage Data is collected automatically when the user is using the Service.

Usage Data may include information such as your Device’s Internet Protocol (IP) address, browser type, browser version, the pages of our Service/Website that you visit, the time and date of the visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When you access the Service through a mobile device, we may collect certain information automatically, including but not limited to, the type of device used, the mobile device unique ID, the IP address of the device, the internet browser used on the device, the device operating system, unique device identifiers and other diagnostic data.

With any other person/entity with your consent: we may disclose your personal information with any other person/entity for any other purpose with your consent.

With any institution pursuant to a court order; where your information is the subject of any court order, judicial rulings or judgment from a judicial or quasi-judicial body or other public authority within the Republic of Kenya.

3. Retention of your Personal Data

The company will retain your personal data only for as long as is necessary for the purposes set out in this Policy. We will retain and use your personal data to the extent necessary for compliance with our legal obligations and applicable laws, resolve disputes and enforce our legal agreements and policies.

4. International Transfer of your Personal Data

Your information, including personal data, is processed at the company’s operating offices and in any other places where the parties involved in the processing are located.  Therefore, information may be transferred to and maintained on computers or systems located outside of this country where data protection laws may differ from those of Kenya.

Your consent to this Privacy Policy followed by your submission of the required information represents your agreement to that transfer.

KHC will take all reasonably necessary steps to ensure that your data is treated securely and in accordance with this privacy Policy and no transfer of your personal data will take place to an organization or to a country unless there are adequate controls in place including the security of your data and other personal information.

5. Disclosure of Personal Data

Business Transactions

If the company is involved in a merger, acquisition or asset sale, your personal data may be transferred. We will provide notice before your personal data is transferred and becomes subject to a different privacy Policy.

Law Enforcement

Under certain circumstances, the company may be required to disclose your personal data if required to do so by law or in response to valid requests by public authorities (e.g., a court, government agency or quasijudicial body)
